1. Acceptance of Terms

By accessing or using the Hera Dent Vet AI service ("Service") provided by Digiray Co., Ltd. ("Digiray", "we", "us", or "our"), a company incorporated under the laws of the Republic of Korea, you ("User", "Veterinarian", or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms govern your use of the AI-powered veterinary dental diagnostic service integrated within the Hera Dent Vet software platform, including all analyses, reports, and credit point transactions.

2. Description of Service

2.1 AI Diagnostic Service

Hera Dent Vet AI is an artificial intelligence service that analyses intraoral dental radiographic images captured by compatible Digiray PSP (Photo-Stimulable Phosphor) scanners. The Service provides:

• Detection and grading of periodontal disease (Stage I–IV) with severity percentage scores per tooth region
• Quantification of disease progression between sequential radiographic examinations
• Probability estimates for associated systemic conditions (including cardiac disease, renal disease, and diabetes) based on detected periodontal burden
• Annotated diagnostic reports suitable for clinical use and client communication

2.2 Software Integration

The Service operates exclusively within the Hera Dent Vet software. Users must hold a valid Hera Dent Vet software licence to access the AI Service.

2.3 AI Infrastructure

All AI computations are performed on Digiray-operated dedicated data centre infrastructure. Images are transmitted securely to Digiray servers for processing and results are returned to the Hera Dent Vet software.

3. Free Trial

New accounts receive a complimentary trial period of thirty (30) calendar days from the date of first activation. During the trial period, the Service may be used for up to three (3) AI analyses per calendar day at no charge. Trial analyses include full access to all diagnostic report features.

No payment method is required to begin the free trial. Upon expiration of the trial period, access to AI analyses requires the purchase of Credit Points as described in Section 4.

4. Credit Points and Payment

4.1 Credit Point System

After the trial period, each AI diagnostic analysis consumes one (1) Credit Point from the User's account balance. Credit Points must be purchased in advance through the payment interface within the Hera Dent Vet software.

4.2 Purchase and Validity

Credit Points purchased by the User remain valid and available for use for the entire duration that the Hera Dent Vet AI Service is commercially operational. Credit Points do not expire based on time or usage inactivity.

4.3 Payment Processing

Payments for Credit Points are processed by Paddle.com Market Limited ("Paddle"), acting as Merchant of Record. By purchasing Credit Points, you also agree to Paddle's applicable terms of service. Digiray accepts payments in major international currencies. All transactions are subject to applicable taxes as determined by Paddle.

4.4 No Subscription

The Service operates on a pay-per-use credit basis only. There are no mandatory monthly or annual subscription fees. Users purchase Credit Points as and when needed.

5. Refund Policy

6. Acceptable Use

6.1 Permitted Use

The Service is intended solely for use by licensed veterinary professionals in the course of lawful veterinary practice. Each analysis must relate to a bona fide patient examination.

6.2 Prohibited Use

Users must not:

• Use the Service for any purpose other than legitimate veterinary diagnostic support
• Attempt to reverse-engineer, copy, or replicate the AI model or its outputs for commercial purposes
• Transmit images that do not constitute genuine veterinary dental radiographs
• Share account credentials with unauthorised third parties
• Use the Service in any manner that violates applicable laws or regulations

7. Medical Disclaimer

The Hera Dent Vet AI Service is a clinical decision-support tool. AI-generated findings and probability scores are intended to assist — not replace — the professional judgment of a qualified veterinarian.

All diagnoses, treatment decisions, and clinical recommendations remain the sole responsibility of the treating veterinarian. Digiray does not assume clinical liability for outcomes based on AI-generated reports. The Service does not constitute the practice of veterinary medicine.

8. Intellectual Property

All intellectual property rights in the Hera Dent Vet AI service, including but not limited to the underlying AI models, software, algorithms, report formats, and associated documentation, are owned exclusively by Digiray Co., Ltd. No rights are transferred to the User by virtue of these Terms or the use of the Service.

Users retain ownership of the radiographic images they upload and the patient records they manage within the Hera Dent Vet software.

9. Data and Privacy

The collection, processing, and storage of personal and clinical data in connection with the Service is governed by Digiray's Privacy Policy, which forms part of these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

10. Service Availability and Changes

Digiray will use commercially reasonable efforts to maintain the availability of the AI Service. However, the Service may be subject to scheduled maintenance, unplanned outages, or temporary interruptions. Digiray does not guarantee uninterrupted access.

Digiray reserves the right to modify, suspend, or discontinue the Service at any time with reasonable prior notice to Users. In the event of permanent discontinuation of the Service, all unused Credit Point balances will be fully refunded in accordance with the Refund Policy.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Digiray's total cumulative liability to any User for any claim arising out of or related to these Terms or the Service shall not exceed the total amount of Credit Points purchased by that User in the twelve (12) months preceding the claim.

Digiray shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of goodwill.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts located in Seoul, Republic of Korea.

13. Modifications to Terms

Digiray reserves the right to update these Terms at any time. Updated Terms will be posted within the Hera Dent Vet software and on the Digiray website. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms.
